General Terms and Conditions of Altocare

§1 Scope of Application

These General Terms and Conditions (GTC) apply to all rental agreements between Altocare (as the main tenant and property manager) and subtenants renting furnished apartments from Altocare.

§2 Rental Object

Altocare rents fully furnished apartments to subtenants for residential purposes. The furniture and all included items in the apartment are the property of Altocare and are provided for the tenant's use during the rental period.

§3 Contractual Relationship

Altocare is the principal tenant of the apartment and sublets it to subtenants. The subtenants do not establish any direct legal relationship with the original property owner. The rental agreement is solely between Altocare and the subtenant.

§4 Rental Period

The rental period is agreed upon in the rental contract. Extensions may be requested by the subtenant but are subject to availability and must be confirmed in writing by Altocare. Early termination of the rental agreement must comply with the conditions outlined in §17.

§5 Rent Payment
  1. Rent Amount: The rent amount, including any applicable VAT, will be agreed upon in the rental contract.

  2. Payment Schedule: Rent must be paid in advance by the first day of each month. For shorter rental periods, the full rent must be paid prior to moving in.

  3. Deposit: A security deposit equivalent to one or two months’ rent may be required, depending on the agreement. The deposit will be held by Altocare and refunded after the rental period ends, provided there are no outstanding damages or unpaid invoices.
     

§6 Included Services

The following services are included in the rent:

  • Use of furniture and household items provided by Altocare

  • Electricity, water, and heating

  • Wi-Fi and TV connection

  • General maintenance of the apartment
     

§7 Additional Services

Optional services, such as laundry, cleaning, or parking spaces, can be arranged for an additional fee. These services must be requested in advance and will be billed separately.

§8 Liability for Furniture and Fixtures

The furniture and other household items provided by Altocare remain the property of Altocare. Subtenants are responsible for any damage to the furniture, fixtures, or apartment beyond normal wear and tear. An inventory list will be provided at the start of the rental period. Any missing or damaged items not reported within three days of moving in will be deemed the responsibility of the subtenant.

§9 Insurance

Subtenants are required to maintain liability insurance covering any damages caused to the apartment, its furnishings, or neighboring properties. Proof of insurance must be provided to Altocare before moving in. If no insurance is provided, Altocare reserves the right to terminate the rental agreement.

§10 Use of the Apartment

The apartment is rented for residential purposes only. Subtenants are not permitted to use the apartment for commercial or illegal activities. Smoking and the keeping of pets are only allowed if explicitly agreed upon in writing.

§11 Maintenance and Repairs
  1. Altocare Responsibilities: Altocare will handle regular maintenance and necessary repairs. Tenants are required to notify Altocare immediately of any damage or necessary repairs.

  2. Access to the Apartment: Altocare reserves the right to enter the apartment for maintenance, repairs, inspections, or viewings for prospective tenants with prior notice of at least 24 hours, except in emergency situations.
     

§12 Subtenant Obligations

Subtenants are required to:

  • Maintain the apartment in good condition and respect the property.

  • Ensure the apartment is properly locked and secured when unoccupied.

  • Adhere to all house rules provided by Altocare or the property owner.
     

§13 Inventory and Condition Check

Upon moving in, the subtenant must review the provided inventory list and report any damages or discrepancies within three days. Upon moving out, a final inspection will be conducted by Altocare, and any damages beyond normal wear and tear will be charged to the subtenant.

§14 Termination and Early Termination
  1. Fixed-Term Leases: The rental contract is binding for the agreed-upon duration. Early termination is only possible if the subtenant finds an acceptable new tenant who takes over the lease, subject to Altocare’s approval.

  2. Open-Ended Leases: For open-ended contracts, subtenants may terminate the agreement with one month’s written notice, effective at the end of the following month.
     

§15 Final Cleaning

A final cleaning fee will be charged to the subtenant at the end of the rental period. If the apartment requires additional cleaning due to excessive wear or untidiness, an additional fee may be applied.
 

§16 Deposit Refund

The security deposit will be refunded within 30 days of the subtenant vacating the apartment, provided the apartment is returned in good condition and there are no outstanding payments. Any deductions for damages or unpaid rent will be communicated in writing.
 

§17 Cancellation Before Move-In

Cancellations are subject to the following conditions:

  • Up to 30 days before the move-in date: Full refund of the deposit.

  • 14 to 29 days before the move-in date: 50% of the rent for the first month is due.

  • Less than 14 days before the move-in date: 80% of the rent for the first month is due.
     

§18 Emergency Situations

In case of emergencies (e.g., water damage, fire), subtenants must immediately inform Altocare and follow the emergency procedures provided.

§19 Internet Usage

Altocare provides internet access as part of the rental agreement. However, Altocare is not liable for any service interruptions or damages caused by viruses, malware, or other internet-related issues.

§20 Changes to the Terms

Altocare reserves the right to amend these General Terms and Conditions. Subtenants will be informed of any changes in advance. Continued use of the apartment after changes are communicated will be considered as acceptance of the new terms.
